THE SALIENT POINTS OF AGREEMENT 1961

TEBRAU AND SCUDAI RIVERS WATER AGREEMENT
Between
THE STATE GOVERNMENT OF JOHORE (Johore)
And
THE CITY COUNCIL OF THE STATE OF SINGAPORE (S'pore)

• This Agreement to supersede the 1927 Agreement;

• Johore to set aside land in Gunong Pulai, Sg. Tebrau and Sg. Scudai with a total area of about 7,195 acres and rent to S'pore for a period of 50 years at a rental of $5.00 per acre per annum;

• Johore to acquire or alienate all other land required by S'pore and S'pore to pay Johore all compensation and all disbursements incurred in land acquisition. S'pore to also pay $5.00 per acre per annum as rental for the alienated land;

• Upon request, Johore to issue Grants of any part of the alienated land to S'pore. S'pore to pay Johore for all expenses for the land Grants but no premium is payable;

• Johore to allow S'pore to construct and maintain dams, reservoirs, tanks, pipelines and all structures, plants and equipments requisite for waterworks. On the expiry of the agreement, Johore may accept the offer to purchase all the above;

• Johore to allow S'pore to lay and maintain pipelines along public roads and Government reserves;

• Johore to allow S'pore to use the impounded water in Gunong Pulai and draw water from Sg. Tebrau and Sg. Scudai. However, S'pore to ensure the sufficiency of compensating flows downstream of the intakes and the maintenance of riverbed levels of the two rivers;

• S'pore to supply treated water to Johore not more than 12% of total water supplied to S'pore over the causeway per day and in any case not less than 4 million gallons. S'pore also to undertake to supply more water to Johore if necessary to meet the Johore's "proper and reasonable requirements";

• S'pore to pay Johore 3 cents for every 1,000 gallons of raw water taken by S'pore;

• Johore to pay S'pore 50 cents for every 1,000 gallons of treated water supplied to Johore;

• In case of emergency, S'pore to supply raw water to Johore and Johore to pay S'pore 25 cents for every 1,000 gallons of raw water supplied;

• The rates of raw and treated water subject to review after the expiry of 25 years of this agreement (in year 1986) taking into account the purchasing power of the currency and the costs of labour and materials; and

• Any dispute or difference to be referred to one arbitrator to be mutually agreed and otherwise to two, one to be appointed by each party and in accordance with the arbitration law of Johore.

Note:
1. No mention of safe yields of dam in Gunong Pulai and of Sg. Tebrau and Sg. Scudai. And also no mention of quantities of water to be drawn from these sources;
2. No mention of whether raw water to be treated by S'pore in Johore or sent to S'pore for treatment.
