THE SALIENT POINTS OF AGREEMENT 1927

AGREEMENT AS TO CERTAIN WATER RIGHTS IN JOHORE
Between
HIS HIGHNESS THE SULTAN OF JOHORE (Johore)
And
THE MUNICIPAL COMMISSIONERS OF SINGAPORE (S'pore)


• Johore to permanently reserve approximately 2,100 acres of land at Gunong Pulai and rent it to S'pore at 30 cents per acre for the exclusive use by the latter to impound and use the water stored within the land. Payments to be made retrospectively from year 1924;

• Johore also to set aside approximately 25 square miles of land and rent it to S'pore at $5.00 per acre for similar purposes as mentioned above. Johore not to alienate any part of this land without the consent of S'pore for a period of at least 21 years;

• Johore to acquire all other land, including land of 33 feet in width (pipeline reserves) required by S'pore which is not State land. But S'pore to pay to Johore the price or compensation paid and all disbursements incurred by Johore;

• Upon request by S'pore, Johore to issue Grants of any part of the reserved land to S'pore. S'pore to pay Johore for all expenses for the land Grants but no premium is payable;

• Johore to allow S'pore to construct and maintain dams, reservoirs, tanks, pipelines and all structures, buildings, plants and equipments requisite for waterworks. All these to remain the property of S'pore;

• S'pore to supply 800,000 gallons of water per day to Johore. However, after year 1929 and upon substantiation given by Johore, S'pore to increase supply to Johore up to a maximum of 1,200,000 gallons per day;

• Johore to pay to S'pore 25 cents for every 1,000 gallons of water supplied to Johore;

• After 15 years, S'pore to furnish Johore their full set of profit and loss accounts for examination to ascertain whether S'pore is making excessive profits from the sale of water from Johore. If the profits are excessive, S'pore to pay to Johore a Royalty on water taken from Johore or the charge of 25 cents per 1,000 gallons paid by Johore to be reduced, but not retrospectively. If no mutual agreement is reached, His Excellency the Governor of the Straits Settlements to be appointed as the arbitrator; And

• All other disputes to be referred to arbitration in accordance with the law of Johore relating to arbitration.

Note:
1. No mention of payment to Johore for the raw water taken by S'pore;
2. No expiry date for the Agreement;
3. No mention of safe yield of the dam and the capacity of water treatment plant and
4. No mention of quantity of raw water supplied to S'pore.
